Welcome to Applion. These Terms of Service ("Terms") apply when you use any Applion app or service, including VibeTown and NoShame ("the Service"). By using the Service, you agree to these Terms. If you don't agree, please don't use the Service.
1. Who We Are
The Service is provided by Applion AI Teknoloji A.Ş., based in Istanbul, Turkey. You can reach us at [email protected].
2. What Our Products Are
Our products are AI chat experiences where you interact with AI characters. The characters are AI — they are not real people, and their messages are generated in the moment.
3. Eligibility
- You must be at least 13 years old to use the Service (16 in the EEA, or the minimum age required in your country). Certain products may require you to meet a higher age threshold as indicated in‑app.
- If you are under 18, you should have permission from a parent or guardian where applicable.
- You must not be barred from using the Service under applicable law.
4. Your Account
If the Service requires an account, you're responsible for keeping your credentials safe and for activity that happens under your account. Let us know right away if you suspect unauthorized access.
5. Acceptable Use
We built our products as spaces for curiosity and self‑discovery. To keep them that way, you agree not to:
- Use the Service to harass, threaten, or harm others.
- Generate or request content that sexualizes minors, promotes real‑world violence, or is illegal.
- Try to extract personal information about real individuals through AI prompts.
- Attempt to reverse engineer, scrape, or interfere with the Service or its AI systems.
- Use the Service to build a competing AI product, or to train another model on its outputs without written permission.
- Upload malware, spam, or automated traffic.
- Bypass safety filters, rate limits, or access controls.
We may suspend or terminate accounts that break these rules.
6. AI‑Generated Content
AI responses are generated by machine learning models. They can be inaccurate, surprising, or contradictory — sometimes all at once. Don't rely on them for medical, legal, financial, or safety‑critical decisions. The characters you chat with are fictional, even when they sound convincing.
7. Your Content
You keep ownership of the messages you send. By using the Service, you grant Applion a limited license to process those messages to generate AI replies, operate the Service, and improve it (in aggregated or de‑identified form where feasible). You're responsible for making sure you have the rights to anything you send us.
8. Our Content
The Service itself — the software, designs, logos, characters, and personality systems — belongs to Applion and is protected by intellectual property laws. You get a personal, non‑exclusive, non‑transferable license to use the Service for its intended purpose. That's it, nothing more.
9. Payments & Subscriptions
Parts of the Service may be free, and other parts may require payment or a subscription. If you subscribe, billing is handled by the applicable payment processor under their terms. Cancellations and refunds follow those policies unless we state otherwise.
10. Third‑Party Services
The Service relies on third parties (cloud hosting, AI model providers, analytics, payment processors). Their terms apply to their parts of the experience, and we are not responsible for their actions.
11. Termination
You can stop using the Service any time. We may suspend or terminate access if you break these Terms, if we are required to by law, or if we discontinue the Service. Sections that by their nature should survive termination (ownership, disclaimers, liability) will survive.
12. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non‑infringement. AI outputs may be wrong or offensive — use your judgment.
13. Limitation of Liability
To the fullest extent permitted by law, Applion and its team will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim, or USD $50, whichever is greater.
14. Changes to the Service or Terms
We may update the Service and these Terms from time to time. If changes are significant, we'll give you notice in‑app or by email. Continued use after changes means you accept the updated Terms.
15. Governing Law
These Terms are governed by the laws of the Republic of Turkey, without regard to conflict of law rules. Disputes will be handled by the courts of Istanbul, unless mandatory local consumer law says otherwise.
